Terms of Service

1. Acceptance of Terms

By accessing or using the ProperEasy platform at propereasy.com.au (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and ProperEasy Pty Ltd (“ProperEasy”, “we”, “us”, or “our”).

If you do not agree to these Terms, you must not use the Platform. We reserve the right to update these Terms at any time; continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

2. Service Description

ProperEasy is an Australian online real estate listing platform that allows sellers, landlords, and licensed real estate agents to advertise residential and commercial properties for sale or rent. Buyers and prospective tenants may browse listings and submit enquiries through the Platform.

ProperEasy is a platform intermediary only. We do not act as a real estate agent, property manager, financial adviser, or legal adviser in connection with any property transaction. All property transactions are conducted directly between the relevant parties.

3. User Accounts

To create a listing or access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and not share your password.
• Notify us immediately at support@propereasy.com.au if you suspect any unauthorised use of your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 18 years of age to create an account. By registering, you confirm that you meet this requirement.

4. Listing Rules

When you create a property listing on ProperEasy, you agree to the following:

• Accuracy: all information in your listing must be accurate, truthful, and not misleading. This includes property address, size, features, price, and photographs.
• Authorisation: you must be the owner of the property, a licensed real estate agent acting on behalf of the owner, or otherwise authorised to advertise the property.
• No misleading content: you must not include false statements, fraudulent representations, or content that violates Australian Consumer Law, including misleading or deceptive conduct under the Competition and Consumer Act 2010 (Cth).
• Compliance: listings must comply with all applicable Australian federal and state laws, including real estate licensing requirements in the relevant jurisdiction.
• Fee payment: listings are subject to applicable fees as set out in Section 5. A listing will not be published until payment has been received or a valid subscription is active.

ProperEasy reserves the right to remove any listing that violates these rules, without notice and without refund.

5. Fees and Pricing

The following fees apply to listings on the Platform (all amounts in Australian Dollars, inclusive of GST where applicable):

Fees are subject to change. We will provide at least 14 days' notice of any fee changes by email or notification on the Platform. Existing paid listings will not be affected by fee changes during the active listing period.

6. Payments and Refunds

All payments are processed securely via Stripe. By making a payment, you agree to Stripe's Terms of Service. ProperEasy does not store your full payment card details on our servers.

No refunds: once a listing is activated and published on the Platform, the listing fee is non-refundable. If a listing is removed by ProperEasy due to a violation of these Terms, no refund will be issued.

If you believe you have been charged in error, contact us at billing@propereasy.com.au within 14 days of the charge. We will investigate and respond within 5 business days.

Nothing in this clause limits any rights you may have under the Australian Consumer Law where those rights cannot be excluded by contract.

7. No Liability for Property Transactions

ProperEasy is a platform that connects buyers, sellers, renters, and agents. We are not a party to any property transaction, rental agreement, or other arrangement between users.

To the maximum extent permitted by Australian law, ProperEasy is not liable for:

• The accuracy, completeness, or legality of any listing.
• Any loss or damage arising from a property transaction or failed transaction.
• Any conduct or representations made by users of the Platform.
• Any loss arising from your reliance on information provided through the Platform, including property valuations or market data.

You are responsible for conducting your own due diligence before entering into any property transaction. We strongly recommend obtaining independent legal, financial, and property advice.

Where liability cannot be excluded under Australian Consumer Law (including for consumer guarantees under the Competition and Consumer Act 2010), our liability is limited to resupply of the relevant service or payment of the cost of resupply.

8. Dispute Resolution

If you have a dispute with ProperEasy, please contact us in the first instance at support@propereasy.com.au. We will use reasonable efforts to resolve the dispute within 30 days.

These Terms are governed by the laws of Victoria, Australia. You and ProperEasy submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any disputes that cannot be resolved by negotiation.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law or other applicable Australian legislation that cannot be contractually excluded.

9. Intellectual Property

All content on the ProperEasy platform — including the website design, software, logos, text, and graphics — is owned by or licensed to ProperEasy and is protected by Australian and international intellectual property laws.

By submitting a listing, you grant ProperEasy a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute the listing content (including photographs) on the Platform and in marketing materials for the purpose of promoting the Platform and your listing. You retain ownership of your listing content.

You must not reproduce, copy, or use any part of the Platform without our prior written consent, except as permitted by law.

10. Termination

You may close your account at any time by contacting us at support@propereasy.com.au. Active paid listings will remain live until the end of the paid period.

ProperEasy may suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. In the event of termination for breach, no refund of listing fees will be issued.

Upon termination, your right to access the Platform ceases immediately. Sections 7 (No Liability), 8 (Dispute Resolution), and 9 (Intellectual Property) survive termination.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, technology, or applicable law. We will notify registered users of material changes by email or by displaying a prominent notice on the Platform at least 14 days before the changes take effect.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
